Terms of Service

1. Who we are

pixelart.dev (the "Service") is operated by PixelNova LLC ("PixelNova", "we", "us"). You can reach us at support@pixelnova.app.

2. What the Service does

The Service generates pixel art game assets from text prompts and reference images using third-party AI image models, then processes the output into sprites, sprite sheets, tilesets and backgrounds you can edit and export. It is a tool; the quality of a given result depends on the prompt, the model and the settings, and we do not guarantee that any generation will match your expectations.

3. Eligibility and accounts

• You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission of a parent or legal guardian who agrees to these terms on your behalf. Paid plans may only be purchased by adults.
• You must provide accurate account information and keep your password confidential. You are responsible for everything that happens under your account.
• One person per account. You may not share, sell or transfer an account.
• Tell us at support@pixelnova.app if you believe your account has been compromised.

4. Plans, credits and payment

• Generations cost credits. Credits come with a monthly subscription plan (Hobbyist or Pro) and are shown on the pricing page, along with what each kind of generation costs.
• Plan credits are granted when a monthly invoice is paid and are replaced, not added to, at the next invoice. Unused plan credits do not roll over.
• New accounts receive a bonus credit balance. Bonus credits can only be spent while a plan is active, are spent after plan credits, and never expire.
• Rebuilding, palette changes and edits in the pixel editor are free. Only new generations spend credits.
• If a generation fails outright, its credits are returned automatically. Credits spent on generations that complete are not refundable, even if you dislike the result.
• Subscriptions renew monthly until cancelled. You can cancel at any time from the billing page; the plan stays active until the end of the period already paid for, and its credits end with it. Except where the law requires otherwise, subscription fees are not refunded for partial periods.
• Payments are processed by Stripe. We do not store your full card details. Prices are in US dollars and may change; we will give notice before a change affects an existing subscription.
• Credits have no cash value, cannot be transferred or resold, and are not a deposit.

5. Your content

"Your Content" means the prompts you write, the images you upload, the assets the Service generates for you, and the edits you make to them.

• You own your outputs. As between you and PixelNova, you own the assets you generate and edit, and you may use them for any purpose, commercial or not, subject to these terms and to the rights of others. Because generated images come from AI models, we cannot promise that an output is unique, that similar outputs will not be produced for other users, or that an output qualifies for copyright protection in your jurisdiction.
• You are responsible for your inputs. You must have the rights to anything you upload or describe. Do not upload images or write prompts that infringe someone else's copyright, trademark or rights of publicity, and do not try to reproduce a specific real person, protected character or branded work.
• License to us. You grant PixelNova a worldwide, non-exclusive, royalty-free license to store, process, reproduce, modify, analyze and display Your Content in order to operate, secure, support and improve the Service. This includes using prompts, generated images, uploads and the edits and choices you make (such as which results you keep, rebuild, approve or discard) to tune our prompts, pipelines and models and to build better defaults. We may also produce aggregated or de-identified data from Your Content and use it for any purpose. We will not publicly display your assets or name you as the author without your permission. This license survives termination for content we have already used to improve the Service, and for copies kept in ordinary backups.

6. Acceptable use

You agree not to:

• Generate or upload content that is illegal, sexually explicit, depicts minors in any sexual or harmful way, promotes violence or hatred against a person or group, or harasses anyone.
• Use the Service to infringe intellectual property rights or to impersonate a person or brand.
• Reverse engineer, scrape, or automate access to the Service beyond the interface we provide, or resell access to it.
• Interfere with the Service, bypass usage limits or credit accounting, or probe its security without permission.
• Use outputs to train a competing image generation service.

Third-party model providers apply their own content filters. A prompt they reject is a failed generation and its credits are returned. We may suspend or close accounts that repeatedly violate this section.

7. Third-party services

The Service relies on third parties to function: AI model providers that draw the images, Supabase for hosting and storage, Stripe for payments, and possibly a privacy-friendly analytics provider. Your prompts and reference images are sent to the model providers to produce your generations. Those providers act under their own terms and we are not responsible for their availability or behavior. Our Privacy Policy explains what each one receives.

8. Our intellectual property

The Service itself, including its software, pixel processing pipeline, design, branding and the prompts and presets we author, is owned by PixelNova and its licensors and is protected by intellectual property laws. These terms do not give you any right to it beyond using the Service as intended.

9. Availability and changes

We may change, add or remove features, models and plans at any time, and may take the Service down for maintenance. We try to avoid data loss but you should export assets you care about. If we discontinue the Service entirely, we will give reasonable notice and a way to export your assets.

10. Termination

You can stop using the Service and ask us to delete your account at any time by emailing support@pixelnova.app. We may suspend or terminate your account if you breach these terms, if required by law, or if the Service is discontinued. On termination your right to use the Service ends; unused credits are forfeited unless the termination was our fault and not caused by a breach, in which case we will refund the unused portion of the current period.

11. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, ORIGINAL, OR FREE OF THIRD-PARTY CLAIMS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PIXELNOVA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow these limits, so they may not apply to you in full.

13. Indemnity

You will defend and indemnify PixelNova against claims, damages and reasonable costs arising from Your Content, your use of outputs, or your breach of these terms.

14. Governing law and disputes

These terms are governed by the laws of the United States and of the state in which PixelNova LLC is organized, without regard to conflict of law rules. Before starting any formal dispute, you agree to contact us at support@pixelnova.app and give us thirty days to try to resolve it. Consumers in the European Union and United Kingdom keep the protections of the mandatory laws of their country of residence.

15. Changes to these terms

We may update these terms. The effective date at the top shows the current version. For material changes we will notify you by email or in the app before they take effect. Continuing to use the Service after that date means you accept the new terms.
